Pierhand terms of use

These terms are an agreement between you and Pierhand ("we"), the maker of the Pierhand app for Windows. You agree to them when you install Pierhand, buy it, or use it. If you don't agree, don't install or use it.

You must be at least 18 years old, or the age at which you can enter into a contract where you live, to buy Pierhand.

What you get

Buying Pierhand lets you use it on up to 2 computers that you use yourself. Some pages of the app can be used without buying. The software is licensed to you, not sold; we keep all rights in it.

Your purchase includes every update we release for version 1 of Pierhand.

Early access

Pierhand is sold as early access. That means it works, but it isn't finished. The website and the Account page of the app list which features have been seen working on a real iPhone and which are still being proven. A feature that is still being proven may not work on your device yet.

If Pierhand doesn't do what you need, the refund policy below is there for exactly that.

Payment

Pierhand is sold by Lemon Squeezy, our reseller and merchant of record, at the price shown at checkout: $20, plus any sales tax or VAT that applies where you live.

It is one payment, not a subscription. Nothing renews, and nothing is ever charged automatically. If we ever charge for a later major version, buying it will be your choice.

Pierhand checks your license over the internet about once a day and keeps working for up to 7 days without a connection.

Refunds

You can get a refund within 14 days of your payment. The full refund policy is on the Refunds page of this website.

What you may and may not do

Use Pierhand only with devices that are yours, or that you have the owner's permission to manage.

You may not:

• share, resell or publish your license key;
• remove or get around the license check;
• use Pierhand to get into a device, an account or information that you have no right to;
• use Pierhand to follow, track, harass or deceive another person;
• use Pierhand to commit fraud, or to break any law or anyone else's rights.

Simulating a location. This feature is meant for testing on a device that is yours. Many apps, games and services forbid simulated locations in their own terms and may suspend or close accounts that use them. Some places and some services also have rules about where you must really be, for example for betting, banking or streaming. Whether and where you use this feature is your decision and your responsibility, and we are not responsible for what an app, a game or a service does about it.

Your device and your data

Pierhand can restore backups, rename a device and restart it. A restore replaces the data on the device and can't be undone. Keep your own backups, and read what each confirmation says before agreeing to it.

Backups made with Pierhand are saved on your computer without encryption. Keep them somewhere you trust.

What Pierhand reads from your device stays on your computer. The privacy policy on this website explains what is sent over the internet and why.

Support

Help is given by email and, when a server is open, on Discord. We do our best to answer, but we can't promise how quickly. Please don't post your license key or anything private in a public Discord channel.

Third-party software and services

Pierhand includes software made by others, listed with its licences in THIRD-PARTY-NOTICES.txt in the app's folder. Those licences apply to those parts, and nothing in these terms takes away rights they give you.

Some features need a free tool called pymobiledevice3, which is separate software under its own licence. You install it yourself, with the app's help; it is not part of Pierhand.

Maps, place search and the license check are provided by other companies. They may change or stop, and features that depend on them may change or stop with them.

Pierhand is an independent app. It is not made, endorsed or supported by Apple. iPhone, iPad and iOS are trademarks of Apple Inc. Changes Apple makes to its devices or software may stop some features working. We will try to keep up, but we can't promise that every feature will work with every device or every iOS version.

Changes to Pierhand

We may add, change or remove features, and we may stop offering Pierhand. If we stop, the copy you bought keeps working for as long as Apple's and Windows' own changes allow, but it will no longer be updated.

Ending this agreement

You can stop using Pierhand at any time.

We may end your license if you seriously break these terms, for example by sharing your key or using Pierhand against another person. If we do, your payment is not refunded, except where the law says it must be.

No warranty

Pierhand is provided "as is" and "as available". To the fullest extent the law allows, we make no warranties of any kind, express or implied, including that it is fit for a particular purpose, free of errors, or compatible with your device, and we don't promise that it will never lose data.

Limits on liability

To the fullest extent the law allows, we are not liable for any indirect, incidental, special or consequential loss, or for loss of data, profits or use of a device, or for an account being suspended or closed, however it arises. Our total liability for any claim about Pierhand is limited to what you paid for it.

Some places don't allow these limits, so they may not all apply to you. Nothing in these terms takes away rights you have under consumer law that can't be given up.

If your use causes a claim against us

If you use Pierhand in a way that breaks these terms or the law, and that leads to a claim against us, you agree to cover the reasonable costs and losses that result, to the extent the law allows.

The law that applies, and disputes

These terms are governed by the laws of the State of Indiana, USA, except where the consumer law of the country you live in says otherwise.

If something goes wrong, please email us first so we can try to put it right. A dispute that can't be settled that way will be heard in the state or federal courts located in Indiana, unless the consumer law where you live gives you the right to use your own courts.

General

If a court finds part of these terms can't be enforced, the rest still applies. If we don't act on a breach straight away, that doesn't mean we have given up the right to. These terms, together with the privacy policy and the refund policy on this website, are the whole agreement between you and us about Pierhand.

Changes and contact

We may update these terms. The current version is always on this page, with the date it last changed. Carrying on using Pierhand after a change means you accept it. Questions: support@pierhand.me
